Some gambling providers and advertisers use the Coronavirus as a way to promote their services. Advertisements such as ‘Corona-free’ gambling have appeared. Most of the time they’ve been created by illegal gambling providers. The Netherlands Gambling Authority announced that these advertisements are forbidden, giving the current circumstances.
A fine of at least 50.000 euros will be given to gambling companies who take advantage of the situation. Earlier, the Gaming Authority asked people to be extra alert to providers and advertisers who are trying to take advantage of the current situation.
Corona free gambling
Legal amusement arcades and gaming casinos have closed their doors because of the Coronavirus. However, the Netherlands Gambling Authority now sees that illegal providers, both online and offline, try to attract consumers with terms such as ‘Corona free gambling’.
Online gambling illegal
The Dutch Law states that it’s illegal to offer games of chance. The fines for companies who do promote online gambling are heavy: 200.000 euros. An increase of this amount of money takes place because of the Coronavirus. For now it’s at least 50.000 euros, but it may increase further. This depends on the nature and quantity of the advertisements.
Also affiliate and review websites
Illegal providers of physical gambling will also be fined more heavily if they advertise their offer with references to the current situation, such as ‘Corona free gambling’. The same applies to advertisers like affiliate and review websites.
License and advertisements
Offering games of chance in the Netherlands is only allowed if a license has been granted. So gambling companies with a license are allowed to advertise. Article 4a of the Games of Chance Act states that advertising must be ‘careful’ though. Advertisements with references to the current situation are not careful and are considered a violation by the Netherlands Gaming Authority.
It’s not an advertisement when a company makes a business announcement because of current circumstances, like a cancellation of an event or when a game or draw is postponed.
